1. Objeto1. Subject

Este acuerdo regula el uso del software desarrollado por Perxal. El software se licencia, no se vende. Perxal conserva la titularidad del software y de todos los derechos no concedidos expresamente en este documento.This agreement governs the use of software developed by Perxal. The software is licensed, not sold. Perxal retains ownership of the software and all rights not expressly granted here.

2. Concesión de licencia2. Licence grant

Perxal te concede una licencia no exclusiva e intransferible para instalar y utilizar el software conforme al tipo de licencia adquirido:Perxal grants you a non-exclusive, non-transferable licence to install and use the software according to the licence type acquired:

• Personal: uso por una sola persona, con activación simultánea en un máximo de dos equipos propios.Personal: use by a single person, with simultaneous activation on up to two of their own machines.
• Studio: uso por el número de personas indicado en la licencia dentro de una misma organización.Studio: use by the number of people stated in the licence within a single organization.
• Educativa: uso con fines docentes y de investigación, no comerciales, en la institución indicada.Educational: use for non-commercial teaching and research purposes at the stated institution.
• OEM o a medida: según las condiciones específicas del acuerdo firmado con Perxal.OEM or custom: according to the specific conditions of the agreement signed with Perxal.

Las licencias Personal y Studio permiten el uso del software en producciones comerciales sin regalías adicionales sobre el material producido.Personal and Studio licences permit use of the software in commercial productions with no additional royalties on the material produced.

3. Restricciones3. Restrictions

• No está permitido distribuir, revender, alquilar ni prestar el software o sus claves de licencia.You may not distribute, resell, rent or lend the software or its licence keys.
• No está permitido descompilar, desensamblar ni realizar ingeniería inversa, salvo en la medida que la ley lo permita expresamente.You may not decompile, disassemble or reverse engineer the software, except to the extent expressly permitted by law.
• No está permitido eliminar avisos de copyright ni mecanismos de activación.You may not remove copyright notices or activation mechanisms.
• No está permitido integrar el software en otro producto sin un acuerdo OEM previo.You may not embed the software in another product without a prior OEM agreement.

4. Activación4. Activation

El software puede requerir activación para verificar la licencia. Los datos utilizados en la activación se limitan a los necesarios para identificar la licencia y el equipo, y se tratan conforme a nuestra política de privacidad.The software may require activation to verify the licence. Data used in activation is limited to what is necessary to identify the licence and the machine, and is processed in accordance with our privacy policy.

5. Actualizaciones y soporte5. Updates and support

Las actualizaciones de mantenimiento y corrección se publican sin coste adicional para las licencias vigentes. Las versiones mayores pueden requerir una actualización de licencia, que se anunciará con antelación. El soporte se presta por correo electrónico en los idiomas español e inglés.Maintenance and bug-fix updates are released at no additional cost for valid licences. Major versions may require a licence upgrade, announced in advance. Support is provided by email in Spanish and English.

6. Periodo de prueba6. Trial period

Si se ofrece una versión de evaluación o de acceso anticipado, su uso se limita a fines de prueba durante el periodo indicado y puede incluir limitaciones funcionales. Las versiones de acceso anticipado pueden contener errores y no se recomiendan para trabajo de producción crítico.Where an evaluation or early access version is offered, its use is limited to testing purposes for the stated period and may include functional limitations. Early access versions may contain defects and are not recommended for critical production work.

7. Garantía limitada7. Limited warranty

Perxal garantiza que el software funcionará sustancialmente conforme a su documentación durante los treinta días siguientes a la compra. Salvo por esta garantía, el software se proporciona «tal cual», sin garantías adicionales de comerciabilidad o adecuación a un fin concreto.Perxal warrants that the software will perform substantially in accordance with its documentation for thirty days following purchase. Except for this warranty, the software is provided "as is", without further warranties of merchantability or fitness for a particular purpose.

8. Limitación de responsabilidad8. Limitation of liability

En la medida permitida por la ley aplicable, la responsabilidad total de Perxal se limita al importe pagado por la licencia. Perxal no responderá de pérdidas de datos, de tiempo de estudio ni de daños indirectos derivados del uso del software.To the extent permitted by applicable law, Perxal's total liability is limited to the amount paid for the licence. Perxal shall not be liable for loss of data, studio time or indirect damages arising from use of the software.

9. Componentes de terceros9. Third-party components

El software puede incluir componentes de terceros con sus propias licencias. Dichas licencias se relacionan en la documentación que acompaña a cada producto y prevalecen sobre este acuerdo respecto de esos componentes.The software may include third-party components with their own licences. Those licences are listed in the documentation accompanying each product and prevail over this agreement in respect of those components.

10. Vigencia y terminación10. Term and termination

Esta licencia es indefinida salvo incumplimiento de sus condiciones, en cuyo caso terminará automáticamente y deberás desinstalar el software. La terminación no da derecho a reembolso salvo que la ley aplicable disponga otra cosa.This licence is perpetual unless its conditions are breached, in which case it terminates automatically and you must uninstall the software. Termination does not entitle you to a refund unless applicable law provides otherwise.

Este acuerdo se rige por la legislación aplicable en el lugar de establecimiento de Perxal [indicar jurisdicción].This agreement is governed by the law applicable at Perxal's place of establishment [state jurisdiction].
