This agreement is between you and Perxal ("Perxal", "we") and covers the Planes audio plug-in, its manuals and any updates we provide (the "Software"). By installing or using the Software you accept these terms. If you do not accept them, do not install the Software.
The Software is licensed, not sold. When you buy a license, Perxal grants you a personal, non-exclusive, non-transferable license to install and use the Software on computers you own or control, for personal and commercial audio work. You may use the Software to create, mix and deliver music, sound and media without paying any further fee; your productions belong to you.
Your license file (.lic) is issued to you and identifies you. Keep it private. Sharing it, publishing it, or letting others use it ends your license.
You may not: copy the Software except for backups; rent, lease, sell, sublicense or distribute it; modify, decompile, disassemble or reverse-engineer it, except where the law expressly allows this despite this restriction; or remove, bypass or tamper with its license protection.
A license may be transferred to another person only with Perxal's written approval, requested at support@perxal.com. The original holder must stop using the Software.
Perxal may offer updates to version 1.x. Support is provided by email at support@perxal.com. Perxal is not obliged to release any particular update or feature.
The Software is provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Loudness readings are measurements intended to assist your judgement; you remain responsible for checking that your deliverables meet the specifications required of them.
To the maximum extent permitted by law, Perxal is not liable for any indirect, incidental, special or consequential damages, including loss of data, projects, profits or business, arising from use of or inability to use the Software. Perxal's total liability is limited to the amount you paid for the license.
This license ends automatically if you breach these terms. On termination you must stop using and delete the Software.
Nothing in this agreement limits rights you have as a consumer that cannot be waived under the law of your country.
The Software includes open-source components (among them the iPlug2 framework) under their own licenses. VST is a trademark of Steinberg Media Technologies GmbH. Audio Units, Logic Pro and GarageBand are trademarks of Apple Inc.
